1. Agreement to Terms

By accessing or using UNCHAINED 3D ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, creators, and others who access or use the Service.

2. Description of Service

UNCHAINED 3D is a marketplace platform that enables creators to publish, distribute, and sell 3D digital content including wallpapers, icons, widgets, docks, and motion icons for Android devices.

The Service includes:

• A marketplace for browsing and purchasing 3D content
• Creator tools for publishing and monetizing content
• Wallet integration for cryptocurrency transactions
• AI-powered tools for 3D content generation
• Community features including profiles and feeds

3. Accounts and Registration

3.1 Account Creation

To access certain features, you must create an account using your cryptocurrency wallet. You are responsible for maintaining the security of your wallet and account credentials.

3.2 Account Responsibilities

• You must provide accurate and complete information
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access
• You may not share or transfer your account to others

3.3 Age Requirements

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are 18 years or older.

4. User-Generated Content

4.1 Content Ownership

You retain ownership of content you upload to the Service. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, and distribute your content solely for the purpose of operating and improving the Service.

4.2 Content Standards

You may not upload content that:

• Infringes on intellectual property rights of others
• Contains malware, viruses, or harmful code
• Is illegal, harmful, threatening, abusive, or harassing
• Depicts violence, hate speech, or discrimination
• Contains pornography or sexually explicit material
• Violates any applicable laws or regulations

4.3 Content Moderation

We reserve the right to remove or modify content that violates these Terms. We do not pre-screen content but may implement automated and manual moderation.

5. Marketplace and Transactions

5.1 Purchases

• All purchases are final and non-refundable unless otherwise stated
• Prices are displayed in USD and transactions occur in POL on Polygon network
• You are responsible for all transaction fees (gas fees)
• We do not guarantee the availability or quality of purchased content

5.2 Creator Earnings

• Creators receive 70% of the purchase price.
• The platform retains 30%, composed of a 20% platform fee and a 10% influencer referral commission (the referral commission applies only to sales made through an influencer's referral link).
• Payouts are automated via smart contracts on Polygon
• Earnings are subject to blockchain transaction confirmations
• We are not responsible for lost earnings due to blockchain issues

5.3 Intellectual Property

Creators must ensure they own or have rights to all content they publish. You are responsible for any copyright or trademark infringement claims arising from your content.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use automated systems (bots) to access the Service without permission
• Collect or harvest personal information from other users
• Engage in fraudulent activities or misrepresentation
• Reverse engineer or attempt to extract source code

7. Blockchain and Cryptocurrency

7.1 Network Risks

Cryptocurrency transactions are irreversible and recorded on public blockchains. We are not responsible for losses due to:

• Network congestion or high gas fees
• Blockchain forks or technical failures
• Loss of private keys or wallet access
• Smart contract vulnerabilities

7.2 Wallet Security

You are solely responsible for securing your cryptocurrency wallet. We cannot recover lost wallets, private keys, or passwords.

8. AI-Generated Content

The Service provides AI-powered tools for content generation. By using these tools, you acknowledge:

• AI-generated content may not be unique and could resemble existing works
• You are responsible for ensuring AI-generated content does not infringe on others' rights
• We do not guarantee the quality or accuracy of AI-generated content
• You may need to disclose AI-generated content depending on your use case

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination, all provisions of these Terms which should reasonably survive termination shall remain in effect, including ownership provisions, warranty disclaimers, and limitations of liability.

10. Disclaimers and Limitations

10.1 Service "As Is"

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted, secure, or error-free operation
• Accuracy or reliability of content

10.2 Limitation of Liability

To the maximum extent permitted by law, UNCHAINED 3D shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill
• Service interruptions or data loss
• Unauthorized access to your account
• Blockchain or cryptocurrency-related losses
• Any damages arising from use of the Service

11. Indemnification

You agree to indemnify and hold harmless UNCHAINED 3D, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.

12.2 Jurisdiction

Any legal disputes shall be resolved in the courts of Queensland, Australia, or through arbitration as mutually agreed upon by the parties.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or platform notification. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
